Experienced Mediation and Arbitration for Individuals & Businesses
SERVING CLIENTS THROUGH NEW ENGLAND AND BEYOND, INCLUDING IN-PERSON MEDIATIONS IN VERMONT, NEW HAMPSHIRE, MAINE AND MASSACHUSETTS
what is mediation?
Mediation is a voluntary and confidential process that allows the parties to design their own outcome to a dispute. Mediation may take place in one session or in multiple sessions. In mediation, parties may all meet with the mediator together, have time alone with the mediator, or use a combination of types of sessions. The process works especially well in situations where the parties want a process to resolve their disagreements outside of the courtroom.
Mediators do not make decisions for the people or organizations involved; instead, mediators assist those involved to explore and develop their own ideas for resolution.
what is arbitration?
In arbitration, parties to a legal dispute submit the matter for binding resolution to a private neutral. Usually the neutral has specific knowledge of the subject matter of the dispute. Arbitration is final: the decision of the arbitrator binds the parties and is enforceable under the law. Our arbitration services are specifically designed to meet the unique needs of parties.
Our arbitrators are experienced practitioners with extensive knowledge of the issues they arbitrate and the law to be applied. They have tried or presided over dozens of cases involving the issues in which they have expertise.
What is Online Mediation?
Online mediation is a convenient and effective way to resolve personal and business conflicts without the need for in-person meetings or traditional litigation. Using secure video conferencing tools like Zoom, parties can participate in structured mediation sessions from the comfort of their own homes or offices. At PRISM, we ensure that the online process mirrors the professionalism, confidentiality, and flexibility of in-person mediation—while offering added accessibility for those in different locations.
Online mediation maintains the core values of neutrality, communication, and confidentiality—while offering the added benefits of convenience and accessibility.
Our arbitrators bring deep practical experience and a thorough understanding of both the subject matter and applicable law. They have handled numerous cases—either as advocates or decision-makers—in the areas where they focus. They oversee proceedings involving:
Probate and trust disputes
Tort claims
Insurance coverage disputes
Construction related claims and disputes
Business & Civil Litigation Mediation
Our mediators are experienced trial attorneys. We have tried dozens of cases involving all kinds of issues. We understand the trial process, and the challenges faced by clients considering or already involved in litigation.
Our civil litigation mediation practice includes working with individuals, businesses, organizations, and associations to resolve disputes regarding issues including:
contract breaches and disputes
civil litigation
construction related disputes
business restructuring and/or dissolution
claims of discrimination and wrongful termination and other employment-related issues
real estate, condominium, easement and boundary disputes
tort and personal injury claims
court-related discovery disputes
zoning challenges
Contract & Commercial
Dispute Mediation
We help businesses resolve a wide variety of commercial disputes, with a focus on creating optimal settlement opportunities while minimizing the risks of expensive and time-consuming litigation.
We are available to mediate virtually all types of business disputes, including:
claims for money owed
disputes concerning allegedly defective products or non-conforming goods
breaches of agreements, including purchase agreements, confidentiality agreements, non-compete agreements, and other matters
other business disputes
Construction Related
Mediation
Our mediators have handled hundreds of construction related disputes. We recognize they can involve complicated contract issues, disputes about liability, significant financial implications and multiple parties with different interests and on-going relationships. Litigating these disputes disrupts projects, causes delays, and increases costs for everyone involved. Our mediators can be available on-site, when you need us, as well as in more traditional mediation settings. We can assist parties with:
disputes between generals and subs
disputes between subs
supplier and vendor issues
insurance-related disputes
disagreements with and between lenders
Employment
Mediation
As former trial attorneys, we are experienced with the litigation process, and the difficult obstacles for effectively resolving employment disputes. Our mediation services are designed to create breakthroughs so that parties to employment disputes can effectively resolve matters prior to trial, whenever possible.
We are available to mediate virtually all types of employment matters, including:
sexual harassment claims
discrimination claims
breach of employment contract
breach of non-compete agreement
breach of confidentiality agreement
matters concerning ownership of intellectual property developed by employees
sales commissions and bonus entitlements
Personal Injury Dispute Mediation
Nearly all personal injury matters are amenable to being resolved prior to trial. Those hurt typically want fair compensation for their injuries, while defendants (and their insurance companies) will be looking for ways in which to reduce legal fees and potential judgments.
With years of both trial and mediation experience, our focus is on helping litigants and their counsel engage in meaningful and productive opportunities for settlement. We have been highly successful in this regard, often helping parties reach a settlement in circumstances where trial seemed a virtual certainty.
Divorce & Family Mediation
The experienced family mediators at PRISM understand the complexities and challenges that accompany family transitions. We also recognize the benefits to families who are able to resolve their disputes outside the litigation process.
We provide a safe, neutral place for clients so that family disputes can be effectively resolved. We will work with you to maximize the preservation of important relationships, minimize future conflict, and explore solutions that work for your family. We serve clients throughout New England and beyond, including New Hampshire, Vermont, and the Upper Valley.
Probate & Other Family Mediation
The death of a loved one is emotionally difficult. The process of recovering from this loss can be compounded when there are serious issues concerning the distribution of the loved one’s estate, both when the loved one had a will (or a will and a trust) or when the loved one died without a will.
Significant disputes can arise for a number of reasons. Jewelry and other personal items may have a much higher sentimental value than monetary value. Real estate, such as a house, cannot be subdivided. Rather than litigating claims and continuing to fight among family, we help family members to reach a settlement concerning estate distribution.
In addition, agreeing on appropriate care for aging, ill or differently abled family members can be challenging. We can facilitate these difficult conversations to reach an solution that works for everyone involved.

Training for Attorneys & Advocates
We offer training sessions for attorneys and advocates in civil cases. We work with individuals and small groups in an intimate setting to strengthen advocacy skills appropriate for mediation. The training is based on a civil case and participants work through many issues that might arise in preparing for and engaging in negotiation and mediation.
